Release of Liability, Terms of Service, and Confidentiality Waiver
1. Agreement to Terms
By enrolling in the 12-Week Private Coaching Program, you (“Client”) acknowledge and agree to abide by the terms and conditions outlined in this agreement. This agreement is legally binding and governs the coaching relationship between you and Darius Bashar.
2. Personal Responsibility & Release of Liability
This program is designed to support personal growth and transformation. By participating, you acknowledge that you are solely responsible for your well-being, decisions, and actions. Darius Bashar and Artist Morning™ are not liable for any personal, financial, or professional outcomes resulting from participation in the program.
Coaching is not therapy, counseling, or medical treatment, nor does it replace professional mental health services. If you require medical, psychological, or therapeutic support, it is your responsibility to seek assistance from a licensed professional.
By enrolling, you release, waive, and discharge any claims against Darius Bashar, Artist Morning™, and their affiliates, associates, or legal representatives from any liability, damages, or injuries, whether physical, emotional, psychological, or financial, arising in connection with this program.
3. Confidentiality & Privacy
This coaching program is built on trust and confidentiality. By participating, you agree to:
Maintain the confidentiality of all discussions and materials shared within the coaching relationship.
Respect the privacy of other participants (if applicable) and Darius Bashar.
Refrain from sharing or distributing proprietary materials without permission.
Confidentiality may only be broken if required by law, such as cases involving harm to oneself or others.
4. No Guarantees & Results Disclaimer
The coaching program provides guidance, tools, and support, but results are not guaranteed. Success depends on your level of commitment, action, and mindset. Testimonials and examples shared in promotional materials do not constitute a promise or guarantee of specific outcomes.
5. Payment Terms & Refund Policy
Full payment is required before the start of the program.
Payments are non-refundable. Once enrolled, no refunds or cancellations will be granted, regardless of participation.
If a payment plan is offered and selected, all payments must be completed as agreed. Failure to make payments may result in suspension from the program.
6. Scheduling & Session Attendance
Coaching sessions are scheduled weekly and will run for 12 consecutive weeks.
Clients are expected to attend all scheduled sessions on time and be fully present.
If a session needs to be rescheduled, at least 48 hours’ notice must be provided. Rescheduling is subject to availability.
Missed sessions without prior notice will not be refunded or rescheduled.
If Darius Bashar needs to reschedule, an alternative time will be provided.
7. Communication & Boundaries
Text/SMS support is available Monday-Friday, 10 AM - 4 PM ET.
Messages will be responded to within 24 hours on business days.
Clients are expected to respect communication boundaries and avoid excessive messaging. If needed, boundaries may be adjusted.
8. Intellectual Property & Program Materials
All materials provided in the coaching program, including meditations, worksheets, and recordings, are the intellectual property of Darius Bashar and Artist Morning™.
Clients may not reproduce, distribute, or share program materials with others.
Unauthorized use or distribution may result in legal action.
9. Program Termination
Darius Bashar reserves the right to terminate participation in the program if:
The client engages in inappropriate, disrespectful, or harmful behavior.
The client repeatedly misses scheduled sessions without communication.
The client breaches any terms outlined in this agreement.
No refunds will be issued in the event of termination.
10. Governing Law & Legal Considerations
This agreement is governed by the laws of Ontario, Canada. Any disputes arising under this agreement shall be resolved through mediation or arbitration before legal proceedings are pursued.
11. Agreement Acknowledgment
By enrolling in the 12-Week Private Coaching Program, you acknowledge that you have read, understood, and agree to abide by these Terms of Service.
